- Following an arrest, the accused is placed in jail.
- In order to get out jail prior to the arraignment date, the accused can work with a bondsman to come up with the bond money, the amount of which is determined by a magistrate.
- The bondsman will pay the whole bail amount for an up-front fee, which is usually 10 percent of the total bond amount.
- The accused can then leave jail.
Later in the process the bondsman receives the bond money back and keeps the 10 percent fee. If the accused flees, the bondsman does not receive the bond money back.
